Section 1: The Four-Office Verification Framework

No single office in Nepal certifies a property as fully legal. Ownership, boundaries, encumbrances, and compliance sit in four separate government offices, each with distinct statutory authority. Verify all four — skipping even one exposes you to void transactions, Rokka [रोक्का] freezes, and criminal liability.

Operating rule: Ownership transfer legally executes only at the Malpot office through registration, Namsari [नामसारी], and Dakhil Kharej [दाखिल खारेज] (Land Revenue Act 2034, Section 8(1)). Every other office feeds that final act.

Section 2: Step-by-Step Legal Clearance Checklist

Phase A: Land Revenue Office (Malpot) Validation

Step 1 — Pull the certified Shrestha [श्रेस्ता] for the exact kitta.

  • The Malpot office maintains records of every land parcel in the district (Land Revenue Act 2034, Section 6).
  • Verify: seller's name, kitta number [कित्ता नम्बर], area, and land class (Maliro [मालिरो]) match the Lalpurja exactly.
  • Red flag: name, age, kitta, area, or class discrepancies — must be corrected under Section 7(3) before any deal proceeds.

Step 2 — Match the Lalpurja against the seller's citizenship certificate.

  • The Lalpurja derives from the survey Field Book (Land Survey Act 2019, Section 2(k2)).
  • Verify: identical name spelling across Lalpurja, Shrestha, and citizenship; all joint owners appear on record.
  • Verify: the seller's single Landowner Code Number (Jagga Dhani Sankhya [जग्गाधनी संकेत नम्बर]) — one code links all land held in Nepal (Land Revenue Act 2034, Section 7A).
  • Red flag: a "seller" not named in the Shrestha owns nothing to sell.

Step 3 — Execute the encumbrance search: Rokka [रोक्का] status.

  • The Malpot office can freeze land when disputes arise (Land Revenue Act 2034, Section 8B(1)).
  • Courts, government offices, banks, financial institutions, and local levels can all order rokka or fukuwa [फुकुवा] (Section 8B(2)–(3)).
  • Unpaid land revenue triggers rokka (Section 15).
  • Demand: a current rokka-status certificate covering court cases, bank mortgages, and tax freezes.
  • Red flag: any active rokka — no transfer until the issuing authority grants fukuwa.

Step 4 — Verify malpot [मालपोत] dues are current.

  • Land revenue falls due yearly by end of Jestha; payment by end of Magh earns a 5% discount; payment after Ashadh 15 adds a 5% fine (Sections 11–13).
  • Demand: current-year receipt; rates are fixed by the local level (Section 10K).

Step 5 — Confirm the land is not government, public, or community land.

  • Registration of Sarkari [सरकारी], Sarvajanik [सार्वजनिक], or Samudayik [सामुदायिक] land in an individual's name is prohibited; any such registration is automatically void (स्वतः बदर) (Section 24(1)–(2)).
  • Criminal penalty: up to 3 years' imprisonment, Rs 30,000 fine, or both (Section 29).
  • Verify: land class in the Shrestha against the Field Book; check for road, river, forest, or Guthi [गुठी] overlap.

Step 6 — Audit the deed chain and minimum valuation.

  • All registration, Namsari, and Dakhil Kharej occur only at Malpot (Section 8(1)).
  • The valuation committee fixes the minimum transaction value (Thaili Aanka [थैली अंक]); deeds below it are rejected (Section 8(2)).
  • Verify: prior sale deeds, inheritance records, and the previous owner's Dakhil Kharej are consistent.
  • Red flag: an unregistered deed — immovable property sales require written, registered deeds (Muluki Civil Code 2074, Property Part).

Step 7 — Verify ceiling and tenancy through the Land Reform Office.

  • Land Act 2021 work is routed to the Bhoomi Sudhar Karyalaya (Land Revenue Act 2034, Section 4); mohi and mortgage changes are reported to it (Section 8(5)).
  • Ceiling: Terai 10 bigha; Kathmandu Valley 25 ropani; other hill districts 70 ropani — plus residential additions of 1 bigha / 5 ropani / 5 ropani (Land Act 2021, Section 7(1)–(2)).
  • Transactions pushing a family above ceiling are void; registration offices must reject them (Section 10(2)–(3)); above-ceiling land cannot be sold (Section 12K).
  • Tenancy: sale deeds must disclose the tenant's name, address, and tenancy terms (Section 26(7)); the seller must notify the tenant and local body within 15 days of sale (Section 26(8)); tenancy rights cannot be sold or donated (Section 26K).
  • Red flag: a hidden mohi entry — the tenant holds statutory rights over the land.

Step 8 — Check the realtor's license (if a professional broker is involved).

  • Professional real estate business above government-notified thresholds requires an Ijazatpatra [इजाजतपत्र] (Land Revenue Act 2034, Section 26K, added by the 2080 amendment); ordinary person-to-person sales are exempt.
  • Licenses run 5 years (Section 26B(4)).
  • Unlicensed dealing: fine up to the transaction amount, or up to Rs 25 lakh / 6 months' imprisonment (Section 26E(1)).

Phase B: Survey Office (Napi) Technical Validation

Step 9 — Verify the cadastral map (Naksa) trace.

  • Maps are maintained in the format prescribed by the Survey Department (Land Survey Act 2019, Section 11(1)).
  • Demand: the naksa trace (Naksa Naksali [नक्सा नक्साली]) for the exact kitta.
  • Verify: plot shape, dimensions, and adjoining kitta numbers match the Shrestha.

Step 10 — Inspect the Field Book (Dakhil Shrestha) for hidden burdens.

  • The Field Book records the owner, mohi, kitta number, area, and land class (Section 2(k2)).
  • Red flag: a mohi entry, area mismatch, or class conflict between Field Book and Shrestha.
  • Map–record mismatches route through Malpot to the Survey office for correction (Land Revenue Act 2034, Section 8A).

Step 11 — Physically verify the plot against map and Field Book.

  • Check boundary lines (Sandh [साँध]) and the kitta [कित्ता] on the ground (Land Survey Act 2019, Section 2(k3)–(k4)).
  • Red flag: physical occupation of government land — occupied government/public land is dakhil'd as government land regardless of possession (Section 6(ग)).
  • Excess area over the record is registered in the owner's name (Section 7) — confirm which kitta absorbs it.

Step 12 — Authenticate the ownership certificate trail.

  • The Jagga Dhani Dakhil Praman Pujagat [जग्गाधनी दाखिल प्रमाणपूजाग] is issued after survey completion (Section 8(1)).
  • Complaints against it lie within 35 days (Section 8(2)); appeals on survey decisions go to the High Court within 35 days (Section 13).

Phase C: Local Municipality (Ward/Palika) Compliance

Step 13 — Verify the land use zone recorded in the Lalpurja.

  • Local levels classify all land into 10 zones — agricultural, residential, commercial, industrial, mining, forest, river/lake/wetland, public-use, cultural/archaeological, and other (Land Use Act 2076, Section 4(1)).
  • The classification is written into the Jagga Dhani Shrestha and Lalpurja (Land Use Regulations 2079, Rule 10; Land Use Act 2076, Section 7(1)).
  • Hard restrictions:
    • No new house construction or infrastructure expansion in the agricultural zone — exceptions only for pre-existing customary residents and rebuilt collapsed homes where the owner holds no other land (Section 11).
    • No commercial plotting (Ghadi [घडी]) development or plot sales outside residential zones (Section 12).
    • Using land contrary to its classification requires Local Land Use Council approval (Section 8(2); Regulations Rule 11).
  • Penalty: unauthorized land use change — fine up to Rs 300,000 plus an order to restore lawful use within 6 months (Sections 24(ग), 25(1)(ग), 25(2)).

Step 14 — Check plot subdivision (Khandikaran [खण्डीकरण]) compliance.

  • Agricultural zone minimum plot sizes: Kathmandu Valley 500 sq.m.; Terai and inner Madhesh 650 sq.m.; other areas 1,000 sq.m. (Land Use Regulations 2079, Rule 12(1)).
  • Residential/commercial zones: minimum 130 sq.m.; 80 sq.m. permitted for road-access plots meeting local road standards (Rule 12(2), 12(2K)).
  • Red flag: a plot carved below these minimums — the kitta-kat [कित्ताकाट] is illegal and the Lalpurja will not issue.

Step 15 — Clear property tax and revenue dues at the Palika.

  • Local levels fix and collect land revenue (Land Revenue Act 2034, Section 10K) and integrated property tax under the Local Government Operation Act 2074.
  • Demand: current-year tax clearance receipts from the Ward office.
  • Red flag: arrears — the Palika can block transfer and the Malpot office can rokka the land (Section 15).

Step 16 — Verify building design map approval (Naksha Pass [नक्सा पास]).

  • Construction requires approved building maps under municipal building bylaws (Local Government Operation Act 2074).
  • Verify: approved naksha, paid permit fees, and setback/height compliance for any structure on the plot.
  • Red flag: an unapproved structure — demolition risk and no building-tax clearance.

Step 17 — Demand the construction completion and occupancy certificate.

  • Built structures require municipality completion certification before lawful occupancy.
  • Red flag: a house sold without a completion certificate — banks refuse loans and resale value collapses.

Step 18 — Verify road access and right-of-way.

  • Road-side plots must meet local road standards (Land Use Regulations 2079, Rule 12(2K)(क)).
  • Land taken for roads can vest in the Government of Nepal (Rule 12(4K)(ख)).
  • Transmission-line right-of-way (Magadhikar [मागाधिकार]) is carved from the plot with compensation (Rule 12K).
  • Red flag: a plot whose road frontage sits on land slated for road acquisition.

Step 19 — Close the loop: execute at Malpot.

  • Final purchase executes as a registered deed, Namsari, and Dakhil Kharej at the Malpot office (Land Revenue Act 2034, Section 8(1)).
  • The Malpot chief holds court-equivalent powers to examine evidence and register documents (Section 32).
  • Adverse Malpot decisions: appeal to the District Court within 35 days (Section 31).
