Question 1

How much land can one family legally own in Nepal? (जग्गाको हदबन्दी कति हो?)

Accepted Answer

A family may hold a maximum of 10 bigha in the Terai, 25 ropani in the Kathmandu Valley, or 70 ropani in hilly regions — plus a separate allowance for a home plot. (Sec. 7(1)-(2)) Region Farmland Limit Extra for Home (घरबारी) Family Total Terai / Inner Terai 10 bigha +1 bigha 11 bigha Kathmandu Valley 25 ropani +5 ropani 30 ropani Other Hill areas 70 ropani +5 ropani 75 ropani 💡 Buyer tip: Before purchasing, calculate your family's current total holdings — including land registered in your spouse's name and children under 16 — because the ceiling applies to the whole family unit, not just you. (Sec. 2(ग))

Question 2

I already own land. Can I buy more?

Accepted Answer

Yes — but only if the purchase keeps your family within the ceiling. The Land Revenue Office will refuse to register (रजिस्ट्रेशन पास) any deed that pushes your family's total holdings over the limit. The seller must submit a partition-based declaration (फाँटवारी) showing your Nepal-wide total stays within limits. भूमि सम्बन्धी ऐन, २०२१ (Sec. 10(2))

Question 3

What happens if I buy land that exceeds my limit?

Accepted Answer

The excess land is confiscated (जफत) by the government — and you lose it entirely. Anyone who acquires land above the ceiling faces a fine of Rs. 1,000 and automatic confiscation of the portion exceeding the limit. The transaction gives you no protection. (Sec. 11(2)) ⚠️ Seller warning: If you sell land in a way that helps a buyer exceed their limit, the deed may not pass registration at all. भूमि सम्बन्धी ऐन, २०२१ (Sec. 10(3))

Question 4

Does land with a tenant (मोही) count toward my ceiling?

Accepted Answer

Only half of it. Tenant-cultivated land is counted 50% toward the landlord and 50% toward the tenant for ceiling purposes. So a plot with a registered tenant "costs" you only half its area against your limit. भूमि सम्बन्धी ऐन, २०२१ (Sec. 7(5))

Question 5

Can I register land in my brother's, friend's, or relative's name to stay under the limit?

Accepted Answer

Don't. This is benami (बेनामी) ownership — and the land can be confiscated. If you acquire land, register it in someone else's name, but actually possess and enjoy it yourself, the law treats it as your own holding for ceiling purposes. If the named owner fails to file the required declaration (विवरण), the land is confiscated to the government. भूमि सम्बन्धी ऐन, २०२१ (Sec. 9(1), (4)) Real risk: Anyone who reports concealed benami land receives 25% of the confiscated land's value as a reward — so hidden holdings are actively hunted. (Sec. 9(6), 14(क)(3))

Question 6

How do I know if the land I want to buy has a tenant?

Accepted Answer

Ask the seller for the land record (लगत) and check for a registered मोही entry at the Land Revenue Office (मालपोत कार्यालय). A tenant who was cultivating the land when tenancy law commenced holds rights that are inherited like ownership — these rights transfer with the land to you as the new owner, whether or not the seller disclosed them. (Sec. 25(1), 26(1))

Question 7

If I buy land with a tenant, can I evict them and use the land myself?

Accepted Answer

No — eviction is only possible through legal process, never by force. A tenant can only be removed by: (1) authority order for unpaid rent, or (2) court order for deliberately damaging the land's productivity or leaving it uncultivated for a year. Forcible eviction costs the owner a Rs. 5,000 fine plus compensation to the tenant for the entire eviction period. (Sec. 29, 32(1)-(2))

Question 8

What must the seller do when selling tenanted land?

Accepted Answer

The deed must name the tenant — and the tenant must be notified within 15 days. The seller must record the tenant's name, address, and tenancy terms in the transaction deed, then notify both the tenant and the local government within 15 days. Failure means a fine of Rs. 5,000–25,000 and the transaction is void. (Sec. 26(7)-(8), 32(5)) 💡 Buyer tip: If the deed doesn't mention a tenant who actually exists, that's a red flag — the sale itself can be challenged.

Question 9

What is land splitting (बाँडफाँड) and should it happen before I buy?

Accepted Answer

Splitting divides tenanted land half-and-half between landlord and tenant, ending the tenancy. If both parties agree, they file a joint application; if they don't, either side can apply and the authority splits the land equally by area or valuation. As a buyer, land that has already been split is cleaner — no tenancy liability follows you. (Sec. 26(ग), 26(घ))

Question 10

As the new owner, how much rent (कूत) can I collect from the tenant?

Accepted Answer

Maximum 50% of the principal crop — no more, ever. You cannot demand more than half the main crop's yield, and you cannot demand free labor (बेगारी) or any payment beyond rent. Violations require paying the tenant double the local wage rate. (Sec. 33, 37; 38(3))

Question 11

The tenant hasn't paid rent. Can I recover it after buying?

Accepted Answer

Yes, but act fast — there's a strict deadline. Rent recovery suits must be filed within 90 days of the due date or 35 days from the deadline, whichever is later. After that, unpaid rent is legally unrecoverable. (Sec. 36(क))

Question 12

The tenant built a house on the land. Who owns that part?

Accepted Answer

The tenant keeps the house, courtyard, and access path — likely in their sole name. When a tenant has built a house on tenanted land and the land is split, the portion with the house goes to the tenant. The landlord receives compensation at current valuation for their lost share. (Sec. 26(ङ)(1)(ग), (2))

Question 13

Can I buy land that was given to a landless Dalit by the government?

Accepted Answer

Not within 10 years — and never by sale. Land provided to landless Dalits cannot be transferred for 10 years, and even after that period only via namsari (inheritance transfer) and anshbanda (family partition) — not open-market sale. Buying such land within the restriction period means the transaction is void. (Sec. 52(क)(2))

Question 14

Can I buy land given to sukumbasi (squatters) or informal settlers?

Accepted Answer

No — this land is locked against transfer. Land provided to landless sukumbasi or informal settlers cannot be transferred by any means except inheritance and partition. There is no waiting period that unlocks market sale. (Sec. 52(ख)(3), 52(ग)(6)) ⚠️ Critical due-diligence point: Always verify whether the seller's land originated from a government distribution program. These plots often look like ordinary private land in the lagat but carry permanent transfer bans.

Question 15

Can I buy land the government redistributed to landless people?

Accepted Answer

Only after 10 years AND full payment of the government price. Recipients of redistributed land cannot sell, gift, exchange, partition, or mortgage it (except to a bank) until the full price is paid and 10 years have passed. (Sec. 23)

Question 16

Can I buy Ailani (ऐलानी) or government land from someone "possessing" it?

Accepted Answer

No — possession of government land creates no ownership. Ailani and unregistered government land belongs to the state. Long-term occupation by informal settlers gives them a route to receive land from the government (Sec. 52(ग)), but it never creates a sellable title you can buy. (Sec. 52(ख)(4), 52(ग) Explanation)

Question 17

Can foreigners or foreign companies buy land in Nepal?

Accepted Answer

Foreign nationals cannot acquire tenancy rights under this Act, and foreign land ownership is prohibited under Nepali law. Non-Nepali citizens are explicitly barred from tenancy rights (Sec. 25(5)(ख)); land can only reach foreign institutions through formal government agreement for approved purposes. (Sec. 12(ज))

Question 18

Can I buy Guthi land?

Accepted Answer

Be extremely careful — Guthi land has special status. Guthi Sansthan's land is exempt from ceilings but is governed by the Guthi Sansthan Act, 2033, and when tenanted Guthi land is split, the tenant must acknowledge the landlord's manchi guthi (worship endowment) obligation. Guthi land transactions require specialized verification. (Sec. 12(च), 26(घ)(2))

Question 19

Can a company or industry buy land above the ceiling?

Accepted Answer

Yes — with government approval and fees. Companies operating industries, institutions, or projects can hold land above the ceiling with Government of Nepal approval, paying prescribed rates: Rs. 150,000/bigha (Terai), Rs. 50,000/ropani (Valley), Rs. 25,000/ropani (hills). (Sec. 12(क))

Question 20

Can I lease or rent excess land held by a company?

Accepted Answer

No — excess land held under government approval cannot be leased or rented out at all. It must be used for the approved purpose only. If you're structuring a business deal involving such land, leasing is legally impossible. (Sec. 12(घ))

Question 21

Can a company sell its excess land later?

Accepted Answer

Only in three situations: (1) dissolution/liquidation with government approval, (2) approved relocation, or (3) a bank selling it to recover loans (one-time, with Ministry approval). Otherwise, no sale, transfer, or mortgage. (Sec. 12(ग))

Question 22

Is buying bank-auction property safe?

Accepted Answer

Verify the timing. Banks and financial institutions can auction land taken as loan collateral within 3 years of acquiring it without extra approval. After 3 years, government approval is required — so check the acquisition date before bidding on bank property. (Sec. 12(च))

Question 23

What did the 2024 (2081 BS) amendment change for institutional land?

Accepted Answer

Institutions holding land above the ceiling must now get an Expanded Project Report (EPR) and Environmental Study (EIA/IEE) approved — and a monitoring committee tracks whether the land is actually used for the stated purpose. Land found misused is confiscated. (Sec. 12(छ), 12(ङ)) 💡 Buyer tip: If you're buying institutional land, ask for the EPR/EIA approval — its absence signals confiscation risk.

Question 24

What is "jafat" (जफत) and how could I lose my land to it?

Accepted Answer

Jafat means government confiscation — it applies to: land hidden from declarations, benami holdings, land acquired above the ceiling, redistributed land resold in violation of rules, and fraudulently obtained land (with fines up to Rs. 100,000 or 1 year imprisonment). If a seller's title has any of these defects, the land can be seized even after you've paid for it. (Sec. 9(4), 11(2), 18(1), 24(2), 52(घ))

Question 25

What does "rokka" (रोक्का) mean on a land record?

Accepted Answer

Rokka is an official freeze — you cannot buy or register rokka'd land. The land office must freeze any land held above the ceiling until the excess-land case is finalized. If you see rokka status in the lagat, walk away until it's resolved. (Sec. 7(7))

Question 26

What is fatawari (फाँटवारी) and why should a buyer care?

Accepted Answer

Fatawari is the mandatory declaration of all landholdings. If a seller never properly filed theirs — or filed a false one — their excess land can be confiscated later, including land you might have already bought. A clean fatawari history is part of title verification. Filing false or incomplete declarations = automatic confiscation. (Sec. 13, 18(1))

Question 27

Someone is threatening to report "hidden land" on property I want to buy. Is that a real risk?

Accepted Answer

Yes — informants receive 25% of the confiscated land's value as a reward. Concealed holdings are actively reported because reporting pays. This is why title defects in Nepal don't stay hidden — they surface years later. (Sec. 9(6), 14(क)(3))

Question 28

If a land decision goes against me, can I appeal?

Accepted Answer

Yes — to the High Court within 35 days, for most decisions under the Act. Exception: landlord-tenant land-splitting decisions are final and cannot be appealed, so settle those disputes at the authority level. (Sec. 26(च), 55)
